Terms of Service

These Terms govern your use of the AKONTEC partner portal at projects.akontec.com, operated by Archadia Blue (trading as AKONTEC Consulting). By creating an account or using the Portal you agree to these Terms.

1. Eligibility

• You must be at least 18 years old and legally able to enter contracts in India
• You must be operating, or seriously intending to operate, a Business Process Outsourcing (BPO) entity
• You must provide accurate, current, and complete information during registration and KYC

2. Account responsibility

• You're responsible for everything done with your account
• Keep your password confidential and do not share access codes
• Notify us immediately at support@akontec.com if you suspect unauthorized access
• One account per person/entity — duplicate accounts will be removed

3. Confidentiality of project documents

Project documentation on the Portal is confidential trade information. By unlocking a project you agree:

• Not to download, screenshot, photograph, or otherwise extract project documents
• Not to share project documentation or access codes with anyone outside your organization
• Not to use project information for any purpose other than evaluating partnership with AKONTEC
• That documents are watermarked with your identity for forensic purposes

Breach of this confidentiality may result in account termination, civil damages, and criminal action under the Indian IT Act 2000.

4. Applications and onboarding

• Submitting an application does not guarantee acceptance — AKONTEC reviews each application against project requirements
• AKONTEC may approve, request additional information, or reject any application at its sole discretion
• Onboarding fees, payouts, and operational terms are set per project and disclosed before contract signing
• ROI projections shown on project pages are illustrative — actual results depend on operational execution

5. Fees and payments

• Onboarding and ongoing fees are billed as separate invoices
• All fees are subject to GST as applicable (CGST/SGST for Tamil Nadu, IGST for inter-state)
• Invoices are due as per the date shown on each invoice
• Overdue amounts may attract interest as specified in your project agreement
• Refunds, if any, are governed by the specific project agreement

6. Prohibited use

You agree not to:

• Use the Portal for any unlawful purpose
• Scrape, harvest, or otherwise extract data using automated tools
• Attempt to bypass security, rate limits, or access controls
• Reverse engineer or decompile any part of the Portal
• Impersonate another partner, AKONTEC staff, or third party
• Submit false information during registration or KYC
• Use the Portal to send unsolicited communications

7. Intellectual property

• The Portal, its content, design, and software are owned by Archadia Blue
• You grant AKONTEC a license to use your name, company name, and logo for partner attribution within the Portal
• You retain ownership of documents you upload (KYC); we use them only for verification

8. Termination

• You may close your account anytime by emailing us
• We may suspend or terminate accounts that violate these Terms, with or without notice
• On termination, the confidentiality obligations in Section 3 survive indefinitely
• Outstanding invoices remain payable

9. Disclaimers

• The Portal is provided "as is" without warranty of uninterrupted availability
• AKONTEC is not liable for indirect, incidental, or consequential damages
• Maximum aggregate liability is capped at the fees you paid AKONTEC in the 12 months preceding the claim

10. Governing law and disputes

• These Terms are governed by the laws of India
• Courts at Chennai, Tamil Nadu have exclusive jurisdiction
• Disputes will first be attempted in good-faith negotiation, then through arbitration under the Indian Arbitration and Conciliation Act 1996

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be emailed to active partners at least 14 days before taking effect. Continued use constitutes acceptance.
